He married Mary PENN at Maker on 25 November 1794. He died in 1826 and was buried at Maker on 15 October 1826, aged 61 years. The will was signed on 14 August 1819 and proved at Maker on 17 May 1827. |
In the name of God Amen.
I, John Waymouth of the Parish of Maker in the County of Devon, cooper, being of sound and disposing mind, memory and understanding, praised be Almighty God for the same, do make this my last will and testament in manner and form following. I give devise and bequeath to my beloved wife Mary Waymouth, all my money, securities for money, goods, chattles (sic) and effects of what nature or kind so ever and where so ever the same shall be at the time of my death, to be holden and enjoyed by her for her own use, and for the benefit of my children during her natural life, or as long as she shall remain a widow. And should she at any time during her widowhood think proper to alter her condition in life and again enter into the state of matrimony, I give and bequeath unto her during her natural life for her own proper use and benefit, so much of my household furniture as shall be thought sufficient for the furnishing of one room, the quantity and the articles for furnishing such room to be determined by herself and my son John Waymouth executor to this my last will and testament, and if they cannot agree as to what articles, or what quantity of articles may be necessary for the furnishing of the said room, then they are to choose a third person between them who shall be thought disinterested to both, and determine the same by arbitration and the decision of either two shall be final, and after her decease the whole of such furniture to be divided in equal shares and proportions among my children after the death of my beloved wife, or her again be married, I give devise and bequeath unto my beloved children all such goods chattles (sic), money and effects of whatever nature or kind so ever as shall be then remaining, to be divided among them in equal shares and proportions. And my will is, and I do hereby empower my executor and executrix hereunder named to sell, transfer, or dispose of, the whole or any part of the property or effects that I may or shall be possessed of at the time of my death, and apply the money arising therefrom to such uses and purposes as they shall think best for the good of my beloved wife and children, any thing heretofore herein contained to the contrary notwithstanding. And I do hereby nominate, constitute and appoint my dear son, John Waymouth, executor and my dearly beloved wife, Mary Waymouth, executrix of this my last will and testament, hereby revoking and making void all and every other will or wills at any time heretofore by me made, and do declare this to be my last will and testament. In witness whereof I the said John Waymouth have hereunto set my hand and seal this 14th day of August in the year of our Lord 1819.
